Terms and conditions

In compliance with the provisions of (i) Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, (ii) Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights, and (iii) Law 34/2002, of 11 July, on information society services and electronic commerce, as well as any other applicable data protection regulations, we provide you with extended information in these Terms and Conditions which, among other matters, govern our Privacy Policy.

These Terms and Conditions govern the use of the service of the web domain https://bexieenergy.com/
and its subdomains (hereinafter, jointly, the “Portal”), which BEXIE GROUP, S.L. makes available to internet users. These Terms and Conditions (which may be periodically modified by BEXIE GROUP) apply to all services available online, through any mobile device, by email or by telephone.

By accessing, browsing and using our Portal, you acknowledge that you have read, understood and accepted the Terms and Conditions set out below (including the section relating to privacy). Use of the Portal entails the status of user of the Portal (hereinafter, the “User”) and implies full and unreserved acceptance of each and every one of the provisions included in these Terms and Conditions, in the version published by BEXIE GROUP at the very moment the User accesses the Portal. Consequently, the User must read these Terms and Conditions each time they intend to use the Portal, since both the Portal itself and these Terms and Conditions may be modified by BEXIE GROUP.

These pages, their content, structure, infrastructure and the services offered through this Portal (the “Service”) are owned by BEXIE GROUP, which operates and manages them. They may only be used for personal and non-commercial purposes, in accordance with the Terms and Conditions detailed below.

The personal data provided through this website will be processed by BEXIE GROUP, S.L., in accordance with Regulation (EU) 2016/679 (GDPR) and the applicable data protection legislation.

Some of the systems and servers used to provide BEXIE GROUP’s services are located outside the European Economic Area (EEA), specifically in the People’s Republic of China, a country that does not have an adequacy decision issued by the European Commission.
Consequently, the processing of personal data may involve an international transfer of data to a country that does not guarantee a level of protection equivalent to that of the European Union.

To ensure an adequate level of protection, BEXIE GROUP has entered into the Standard Contractual Clauses approved by the European Commission (Article 46.2(c) of the GDPR) with its service providers in China and has implemented additional technical and organisational measures to guarantee the confidentiality, integrity and availability of the information processed.

Where it is not possible to apply appropriate safeguards, the transfer will only be carried out on the basis of the user’s explicit consent, or where the transfer is necessary for the performance of a contract between the data subject and BEXIE GROUP, or for the implementation of pre-contractual measures requested by the user.

All the contents of the Portal (texts, photographs, images, software, source code, etc.) are the intellectual and/or industrial property, as applicable, of BEXIE GROUP or of third parties, and may not be reproduced, transmitted, copied, distributed, manipulated or used in any way and for any purpose without the prior express written authorisation of BEXIE GROUP, with the copyright and any other indication of the intellectual property rights of the materials or contents remaining intact at all times. Any use or modification of the contents of the Portal for a purpose other than that authorised in these Terms and Conditions will be considered an infringement of the international copyright regulations protecting intellectual property rights.

Trade marks, trade names or distinctive signs are owned by BEXIE GROUP or by third parties, and access to the Portal may not be understood to grant any right over such trade marks, trade names and/or distinctive signs.

What kind of personal information does BEXIE GROUP use?

Each time you visit our Portal, we may collect certain information, such as your IP address, the browser you use and information about your computer’s operating system, the browser version, language settings and the pages you have been shown. If you use a mobile device, we may also collect data that identify your device, such as the operating system version and language settings.

We may also receive information about you when you use certain social media services.

In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, as well as any other applicable data protection regulations, your personal data will be incorporated into and processed in the files owned by BEXIE GROUP for the purpose of providing and offering you our services, with the provision of the email address or other personal data being a necessary requirement for contracting certain services.

Users grant their consent for such data to also be processed and used for sending commercial communications intended to promote or advertise the services and products offered by BEXIE GROUP.

What are the User’s rights when providing us with their personal data?

The User has the right to obtain confirmation as to whether BEXIE GROUP is processing personal data concerning them, as well as to access their personal data, request the rectification of inaccurate data or, where appropriate, request its erasure when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain circumstances, the User may request the restriction of the processing of their data, in which case they will only be retained for the exercise or defence of claims.

Likewise, in certain circumstances and for reasons relating to their particular situation, the User may object to the processing of their data. In such a case, BEXIE GROUP will cease processing the data, except for legal reasons or for the exercise or defence of possible claims.

The User may exercise the right to the portability of their data, receiving them in a structured, commonly used and machine-readable format, and transmitting them to another data controller. Such exercise may involve the payment of a reasonable fee, based on the resulting administrative costs, in accordance with the applicable regulations.

The User may raise any matter relating to this Policy, as well as exercise their legal rights, by communication via email or post addressed to the Data Controller, stating the relevant request and attaching a copy of their identity document.

If they do not obtain satisfaction in the exercise of their rights, the User may lodge a complaint with the Spanish Data Protection Agency, the supervisory authority competent in this matter.

How does BEXIE GROUP share your data with third parties?

4.1. Obligation to make correct use of the Portal

The User undertakes to use the Portal in accordance with the legislation in force at any given time in the Kingdom of Spain, with these Terms and Conditions, as well as with morality, generally accepted good practice and public order, being liable to BEXIE GROUP or to third parties for any damages that may arise from the breach of such obligation.

In using the Portal, the User undertakes not to carry out any conduct that could damage the image, interests or rights of BEXIE GROUP or of third parties, or that could damage, disable or overload the Portal, or in any way prevent its normal use. To this end, the User must refrain from using the Portal for unlawful purposes or with harmful effects on the rights or interests of third parties, or that may in any way damage, disable, overload or impair the normal functioning of the Portal, or that in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or computer products and applications (software) of BEXIE GROUP or of third parties.

4.2. Inserting links to the Portal

Users wishing to insert links from their own websites to the Portal must comply with the conditions detailed below:

The link will only allow access to any page of the Portal, but may not reproduce it in any way (“inline” links, copies of texts, graphics, etc.).

It will not be stated or implied that BEXIE GROUP has authorised the link or that it has in any way assumed or supervised the services offered or made available on the website where the link is established.

The establishment of the link will not imply, in any case, the existence of any relationship between BEXIE GROUP and the owner of the website where it is established, nor the acceptance or approval by BEXIE GROUP of its contents or services.

The page establishing the link must faithfully comply with the law and may not, in any case, make available or link own or third-party contents that are unlawful, harmful or contrary to morality and good practice, or that are inappropriate or incompatible with the activity of BEXIE GROUP.

On behalf of our company, we process the information you provide to us for the purpose of providing the services described in our Terms and Conditions, available for consultation on the Portal https://bexiegroup.com/
, and, where applicable, in the service provision contract signed with you, as well as to carry out administrative, accounting, financial and invoicing management.

The personal data provided will be retained for as long as the professional relationship is maintained or for the years necessary to comply with legal obligations. The data will not be transferred to third parties, except in cases where there is a legal obligation or some other legitimate basis provided for in the applicable regulations, such as the performance of a contract or the consent of the data subject.

You have the right to obtain confirmation as to whether at BEXIE GROUP we are processing personal data concerning you, as well as to access your personal data, rectify inaccurate data or request its erasure or cancellation when the data are no longer necessary for the purposes for which they were collected.

Mere access to and visiting of the Portal does not imply the automatic recording of personal data identifying the User.

However, the use of certain services or requests addressed to BEXIE GROUP may be conditional on the prior completion of the relevant User registration, in which you may be required to provide certain personal data.

In particular, the submission of forms involves the collection of personal data for the provision of the relevant services. In the data collection forms, the fields marked with an asterisk are mandatory, so that failure to complete them may give rise, at BEXIE GROUP’s discretion, to the refusal of the requested service.

All the information that the User provides through the Portal’s forms must be truthful. To this end, the User guarantees the authenticity of all the data communicated and undertakes to keep it up to date, so that it corresponds at all times to their real situation. The User will be solely liable for any false or inaccurate statements they make and for the damages they cause to BEXIE GROUP or to third parties as a result of the information provided.

The data collected through the Portal’s forms will be incorporated into an automated personal data file for which BEXIE GROUP is responsible, and will be treated as confidential. In the case of online enquiries, the information will be used to respond to the questions raised and to manage the relationship with customers, as well as to promote the services offered by BEXIE GROUP. The data will be used for the provision of the entity’s ordinary services, with the only recipients of the information being those responsible at BEXIE GROUP who must take part in its processing.

BEXIE GROUP will adopt the necessary measures to prevent the alteration, loss, processing or unauthorised access to the data, in accordance with the applicable regulations. However, technical security on the internet is not impregnable and improper access derived from malicious actions by third parties may occur.

4.4. Linked sites

The Portal may make available to the User technical linking devices that allow access to other websites and internet portals (hereinafter, the “Linked Sites”).

In these cases, BEXIE GROUP acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI), and will only be liable for the contents and services supplied on the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has not deactivated the link with due diligence.

BEXIE GROUP does not know the contents or services of the Linked Sites and, therefore, is not liable for the damages arising from the unlawfulness, quality, unavailability, error or uselessness of the contents and services of such Linked Sites, nor for any other damage that is not directly attributable to BEXIE GROUP.

5.1. Scope of our Services

Through the Portal, BEXIE GROUP makes available an online platform through which professional services are provided.

Although we try to make our service as accurate as possible, we cannot verify or guarantee that all the information is accurate, complete or correct. Likewise, we are not liable for errors (such as obvious or typographical errors), interruptions (due to temporary and/or partial server interruptions, repairs, updates and Portal maintenance tasks or other causes), inaccurate, misleading or false information, or for the lack of information.

Our services are intended exclusively for personal and non-commercial use. Therefore, it is not permitted to resell, sub-license, carry out deep-links, copy, monitor (for example, by means of “spiders” or “scraping”), display, download or reproduce the content, information, software, products or services available on the Portal for any commercial or competitive activity.

5.3. Disclaimer of liability for Users

Subject to the limitations established in these Terms and Conditions and to the extent permitted by law, we will only be liable for the direct damages that you suffer, pay or incur as a result of breaches attributable to our obligations in relation to our Services.

Under no circumstances will BEXIE GROUP be liable for damages of any nature that may be caused by third parties unrelated to BEXIE GROUP. Likewise, BEXIE GROUP will not be liable for the damages that you suffer, pay or incur as a result of the processing of data carried out by third parties.

To the maximum extent permitted by law, neither BEXIE GROUP nor any of its directors, employees, representatives, distributors, affiliates, licensors, agents or other persons involved in the creation, sponsorship and promotion of the Portal and its contents will be liable for:
(i) punitive, special, indirect or consequential damages, loss of production, profits, revenue, contracts, goodwill or reputation, as well as loss of claims;
(ii) errors related to the description of the information (including that relating to prices, availability and ratings) of the Services offered on the Portal;
(iii) services provided or products offered by other business partners;
(iv) losses, damages or costs (direct, indirect, consequential or punitive) arising from the use, unavailability or delay of the Portal; or
(v) personal injury, death, material damage or other harm suffered, incurred or paid by the User, whether arising from legal acts, errors, breaches, gross negligence, wilful professional malpractice, omissions, breaches, false statements, strict liability or whether wholly or partly attributable to establishments or business partners whose products or services are offered directly or indirectly through the Portal, including cases of cancellation, strike, force majeure or other acts beyond our control.

By uploading information to our system, you certify, warrant and confirm that you are the owner of the copyright of the photograph or image and that you authorise BEXIE GROUP to use such image on its websites (including mobile ones), mobile applications and promotional materials (online and offline), as well as in any publication that BEXIE GROUP deems appropriate. You grant BEXIE GROUP a non-exclusive, universal, irrevocable, unconditional and permanent right and licence to use, reproduce, display, distribute, sub-license, communicate and make available such images in the manner that BEXIE GROUP deems appropriate.

By uploading such photographs or images, the User accepts legal and moral liability for any third-party claim arising from their use and publication by BEXIE GROUP. BEXIE GROUP does not own or endorse in any way the images uploaded. The truthfulness, validity and legitimacy of the use of the images will be the sole responsibility of the person who uploaded them, and in no case will it be attributable to BEXIE GROUP, which disclaims any liability in this regard.

The person who uploads the images guarantees that they do not contain viruses, trojans or other infected files, nor pornographic, illegal, obscene, offensive, inappropriate or unlawful material, and that they do not infringe third-party rights (intellectual property, copyright or privacy). Any image that does not meet these requirements will not be published and/or may be removed by BEXIE GROUP at any time and without prior notice.

5.4. Intellectual and industrial property rights

Unless expressly stated otherwise, the software necessary for the provision of our Services or used on the Portal, as well as the intellectual and industrial property rights (including copyright) over the contents, information and materials of the Portal, are owned by BEXIE GROUP.

BEXIE GROUP reserves exclusive ownership of all rights, title and interest in the Portal (including its appearance and infrastructure), and the User is not authorised to copy, compile, link, publish, promote, sell, integrate, use or combine the contents (including their translations) or the BEXIE GROUP brand without prior written authorisation.

In the event that the User uses, in whole or in part, contents of the Portal or claims ownership of intellectual or industrial property rights over them, it will be understood that they assign and transfer such rights in favour of BEXIE GROUP. Any improper use or action contrary to the provisions herein will constitute an infringement of the intellectual and industrial property rights of BEXIE GROUP, including copyright and database rights.

6.1. The User of the Portal is aware of and voluntarily and expressly accepts that the use of this Portal is carried out under their sole and exclusive responsibility.

BEXIE GROUP, its partners, collaborators, employees and representatives are not liable for the errors or omissions that may exist in the contents of the Portal or in other contents that may be accessed through it.

Access to the Portal does not imply any obligation on the part of BEXIE GROUP to verify the truthfulness, accuracy, suitability, appropriateness, completeness or currency of the information provided through it. The contents of this page are merely informative and general in nature.

BEXIE GROUP, its partners, collaborators, employees and representatives will not be liable for the damages that may arise from the use of the Portal, nor for the actions taken on the basis of the information provided on it, nor for the decisions adopted on the basis of such information, nor for the damages caused to the User or to third parties as a result of actions based exclusively on the information obtained through the Portal.

6.2. The User must be aware that the security measures of computer systems on the internet are not completely reliable and that, therefore, BEXIE GROUP does not guarantee the absence of viruses or other harmful elements that may cause alterations or damage to the User’s computer systems (software and hardware) or to the electronic documents and files stored therein.

6.3. Access to the Portal requires services and supplies from third parties, including transport services through telecommunications networks, whose reliability, quality, continuity and operation do not depend on BEXIE GROUP. Consequently, BEXIE GROUP will not be liable for damages of any nature that may arise for the User as a result of failures or disconnections in the telecommunications networks that cause the suspension, cancellation or interruption of the Portal service during its provision or prior to it.

BEXIE GROUP, S.L. will not be liable for damages arising from interruptions, errors or technical failures of the website, nor for its improper use by users.
The company will also not be liable for the content, availability or accuracy of third-party websites that may be accessed through links included in this website.

What security measures does BEXIE GROUP use to protect your personal information?

In accordance with the European regulations in force on data protection, we use strict security measures to prevent unauthorised access and improper use of personal information.

In order to protect and safeguard the personal data you have provided to us, we have implemented appropriate business procedures and systems. Likewise, we apply physical and technical security measures and restrictions for access to and use of the personal information stored on our servers.

State “Request for personal information” in the subject of the email and include a copy of your identity document to help us prevent unauthorised persons from accessing your personal data.

If the personal information we hold about you is not correct, we will update it at your request. If you no longer wish to use BEXIE GROUP’s services, you can ask us to block your personal information to prevent its further use. Likewise, you can delete your User account at any time by logging in to our Portal.

You can unsubscribe from the Portal’s newsletters at any time by clicking the “Unsubscribe” link found at the end of each newsletter. Requests to update, block or delete personal information must be sent by email to info@bexiegroup.com. Please note that, in certain cases, it may be necessary to retain certain information, for example, for legal or administrative reasons, to process claims or to detect fraudulent activities.

10.1. Applicable law

These Terms and Conditions, as well as the rest of the legal conditions of the Portal, are governed in each and every one of their aspects by Spanish legislation, and in particular by the Law on Information Society Services and Electronic Commerce (Law 34/2002, of 11 July) and by Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

10.2. Miscellaneous

Any dispute that may arise from these Terms and Conditions and from the services provided by BEXIE GROUP will be submitted, at the consumer’s choice, to:
(i) the competent courts and tribunals of the place of their domicile, or
(ii) the competent courts and tribunals of Oviedo, Principality of Asturias, Kingdom of Spain.

For the rest of the Portal’s users who do not have the status of consumers, these Terms and Conditions and the services provided by BEXIE GROUP will be governed and interpreted exclusively in accordance with the legislation in force in the Kingdom of Spain, and any dispute that may arise from them will be submitted exclusively to the competent courts and tribunals of Oviedo, Principality of Asturias, Kingdom of Spain.

In the event of discrepancy regarding the content or interpretation of these Terms and Conditions, as well as in the event of conflict, contradiction or divergence between this version and other versions in different languages, the Spanish version will prevail, and will be the only binding one to the extent permitted by law. The Spanish version may be consulted on the Portal (by selecting the relevant language) or requested in writing from BEXIE GROUP.

If any of the provisions of these Terms and Conditions is declared null or unenforceable, or becomes so, the remaining provisions will continue to be fully valid and binding. In such a case, the invalid provision will be interpreted and applied to the maximum extent permitted by the applicable legislation and, as far as possible, will be replaced by another provision that produces an effect as similar as possible to that of the provision declared invalid, taking into account the content and purpose of these Terms and Conditions.
